Things Surviving Family Members Should Know About Wrongful Death Cases

Drivers in California have a duty to follow the rules of the road and watch out for the most vulnerable users on the roadway, including cyclists and pedestrians. When a driver fails in their obligation to protect others and prevent crashes, they may be held liable for resulting damages. This may be accomplished through a personal injury claim for an injured party or a wrongful death claim on behalf of survivors. In California, wrongful death is defined as the loss of life from an accident that results from another party’s negligent or reckless acts.

To bring a successful wrongful death action forward, your lawyer must provide clear and compelling evidence to demonstrate that the other side’s actions were the direct cause of the incident that led to the loved one’s death and resulting damages. Evidence may include medical records, incident reports, video surveillance footage of the crash scene, pictures, expert witness testimony, statements from eyewitnesses, and more.

California law is specific to which surviving family members have the ability to file a wrongful death claim. The children, a domestic partner, or a spouse of the deceased have priority for filing a case. Refer to the California Code of Civil Procedure Section 377.60 for more details. If you have questions about the process and what to expect from it moving forward, contact an experienced Modesto wrongful death lawyer for a free case evaluation.
